FAMILY EDUCATIONAL RIGHTS AND PRIVACY ACT OF 1974

EXCERPTS FROM THE SCHOOL CODE OF ILLINOIS
Relating to Student Teachers 105 ILCS Sub. Sec. 5/10-20.20 PROTECTION FROM SUIT. To indemnify and protect school districts, members of school boards, employees, volunteer personnel authorized in Sections 10-22.34, 10-22.34a, and 10-22.34b of this Code, and student teachers against civil rights damage claims and suits, constitutional rights damage claims and suits, and death and bodily injury and property damage claims and suits, including defense thereof, when damages are sought for negligent or wrongful acts alleged to have been committed in the scope of employment or under the direction of the board. Such indemnification and protection shall extend to persons who were members of school boards, employees of school boards, authorized volunteer personnel or student teachers at the time of the incident from which a claim arises. No agent may be afforded indemnification or protection unless he was a member of a school board, an employee of a board, an authorized volunteer or a student teacher at the time of the incident from which the claim arises. 105 ILCS Sub Sec. 5/10-22.3 Liability insurance for school board members, school board employees, and student teachers. To insure against any loss or liability of the school district, members of school boards, employees, volunteer personnel authorized in Sections 10-22.34, 10-22.34a, and 10-22.34b of this Code and student teachers by reason of civil rights damage claims and suits, constitutional rights damage claims and suits and death and bodily injury and property damage claims and suits, including defense thereof, when damages are sought for negligent or wrongful acts allegedly committed during the scope of employment or under the direction of the school board. Such insurance shall be carried in a company licensed to write such coverage in this state. Amended by P.A. 79-210, #1, effective. THE STATE OF ILLINOIS, 1980 [Rules 17.01, 17.02, and 17.03]
17.01-1 CLINICAL EXPERIENCES. That part of the professional preparation program enabling candidates preparing for certificated roles to acquire practical experience along with theoretical knowledge prior to entering into the full responsibilities of the role for which they are seeking certification. These practical and structured experiences insure gradual and sequential introduction to, and eventual assumption of, the full range of experiences associated with a certificated role. At appropriate times the candidate demonstrates mastery of skills and techniques necessary for effective performance as a beginning practitioner and to enable evaluation by qualified personnel. The sequence of experiences brings the candidate into contact with a variety of populations and educational situations, including public school settings, encountered by practitioners.
17.01-6 STUDENT TEACHING. A form of internship established by Illinois statute calling for "close and competent" supervision. It entails preparation for full responsibility in an instructional setting. In the course of the experience, the candidate demonstrates mastery of techniques, skills, including, but not limited to, planning, organization, evaluation, parental relations and competence in subject matter areas. The experience is carried out under diligent and systematic supervision by college and local school personnel.
17.02-6 STUDENT TEACHING. The student teacher shall not be used as a teacher or substitute teacher.
17.03-1 PAY FOR STUDENT TEACHING. If employed teachers are to receive credit for student teaching, the student teaching must be performed at a time for which the teacher is not paid. Student teachers are not permitted to be paid while student teaching.
17.03-2 No student engaged in pre-student teaching clinical experiences or student teaching may receive remuneration for work, if any, performed in connection with such experiences.
ILSC 5/10-21.9 CRIMINAL BACKGROUND CHECK. Illinois law requires school boards to conduct a criminal background investigation on applicants for employment. This law prohibits the employment of any person who has been convicted of committing or attempting to commit any one or more of a number of offenses. At present, offenses include first degree murder; any Class X felony; juvenile pimping; soliciting for a juvenile prostitute; exploitation of a child; obscenity; child pornography; harmful material; criminal sexual assault; aggravated criminal sexual assault; criminal sexual abuse; aggravated criminal sexual abuse; offenses set forth in the Cannabis Control Act, and crimes defined in the Illinois Controlled Substances Act. Employment must be denied where the offenses and / or conviction occurred inside or outside the state of Illinois.
